The first step in the process is to have a Feasibility Tax Report completed. Scope & Report Development:  Our appeals are not formal appraisals, since we offer our clients the capability to pay for our services with a contingent fee of the tax savings achieved in a successful appeal.  While contingent fee payments are not allowed in the appraisal profession, the state of Colorado allows tax agents to utilize them in tax appeals, as taxpayers often prefer this type of payment option.  Our reports contain the same analysis and support for our value conclusions that is included in typical appraisal reports.  We have found that it makes little difference if the report we prepare is an appraisal report or a Tax Protest Report.

The key to our success is our knowledge of the market and the analysis and presentation of relevant market data.  Our custom designed computer database systems enable us to provide these services effectively and efficiently.  The Tax Protest Report will be developed utilizing the Property Data on record with the Eagle County Assessors office. If the Client believes there may be errors in the Property Data, arrangements may be made to have the Assessor’s office staffs personally inspect the property to determine if corrections are in order. Or, at the Owner’s request, our staff may inspect the property.

Fees

Our program is designed to provide the support that clients need in an equitable and cost-effective manner. Prices for a Feasibility Tax Report start at $199 and increase with the value of the property.  Properties with lower values are charged a smaller fee than those properties with higher values.

If we can support a reduction in value, we will file a Tax Protest Report with the Assessor and take the appeal to a reasonable conclusion.  Our compensation will be a 38% Contingent Fee of any tax savings generated over the two tax years affected by this valuation.  The Contingent Fee payment plan allows you to pursue the appeals process without the payment of up-front fees. When we file an appeal, we only get paid if we are successful in achieving a reduction in value for your property.

Important Tax Protest Dates

May 15, 2023

Order Tax Appeal Appraisal services from Eagle County Tax Appeal by this date to receive the most economical pricing of our services. Price increases may be installed after May 16, 2023 due to the severe time constraints involved in submitting appeals by the June 1, 2023-deadline.

June 1, 2023

Don’t Delay! If you want to file a protest, You Must Act Quickly! If your protest is not postmarked and mailed to the county by June 1, 2023 (or hand delivered in person by June 1, 2023), you lose your right to protest your assessed valuation for the 2023 calendar year. If you hire Eagle County Tax Appeal to prepare your tax appeal, we will deliver it to Eagle County by the above deadlines.

June 30, 2023

The Assessor’s office must provide a response to your appeal by the last working day in June. This value is known as the Notice of Determination. If you hire Eagle County Tax Appeal to prepare your tax appeal, we will also receive a copy of the Notice of Determination. We will notify you of the county’s determination along with an estimate of the tax savings you have achieved. You will also be provided an estimate of the potential additional tax savings you can achieve if you are successful in achieving further reductions in a continued appeal.

July 15, 2023

If we are not satisfied with the assessor’s decision, you must file a written appeal with the County Board of Equalization. Your appeal must be postmarked or delivered on or before July 15, 2023. Eagle County Tax Appeal will prepare and present your appeal at the County Board of Equalization (CBOE) hearings. If you have selected the Contingent Fee payment plan, there is no additional fee for our preparation and attendance at this hearing. If you selected the Fixed Fee payment plan, an additional fee is needed to represent you at the CBOE hearing, or you have the option to convert to a Contingent Fee plan with no additional up-front fees required. This fee takes into consideration what additional supporting documentation (maps, photographs, supporting date & analysis) is needed to present your appeal at the CBOE hearings.

August 10, 2023

The CBOE’s decision will be issued no later than August 10, 2023. If you are not satisfied with the decision, an appeal must be submitted to the District Court or to the Board of Assessment Appeals, or a request for Arbitration. The appeal must be submitted in writing no later than thirty (30) days after the CBOE’s decision is mailed. Many owners receive the relief they are looking for from the CBOE hearings.
